Car is 2005 e53 3.0d and the EML does not come on when you switch ignition on, it does however light up during instrument cluster self test.

This is a problem here in the UK as there are new rules for the annual MOT (inspection for road use) which say that unless EML comes on with ignition then it must fail the test.

There are no faults logged (checked by ICOM Next and ISTA+)

Any one come across this before or any ideas please ?

Do the regulations not stipulate that it should behave per original EU regulations?
In some cases the MOT is less stringent than the RoI NCT, an example being SRS light?
Have you a link to the new regulations so that I may read them.
