This firmware was used from F020-18-11-500 to F020-19-07-562. So ISTA 4.37 should handle it, as it was released in 2022.

So probably the problem is that iLevel contained in car's VCM backup is crap as was my first idea.

I mean which ECU has a old Software ?

Not old software. Your problem ISTA does not recognize factory i-level. So you could write proper factory i-level to the new FEM or fix it in the backup module.

But another Question: If i bring the car to BMW, how they will do that? They dont use Esya

Either their ISTA will download correct factory level from BMW or they will contact BMW who will use ESys over IRAP, or they will ask someone who has ESys to fix it for them

Most likely they will contact technical support to rewrite VCM correctly through IRAP.
