So on the advice of @Krug (many thanks to him for helping with other things over pm), I have fitted the newer FRM but still have the same issue.

New FRM with 106D cafd has been coded both with the original car build date of 0313 and 0713,
Coding 5AS to DSC/ICM/Kombi/NBT/Kafas/FRM with build 0313 or 0713 gives 2 of the same errors.

Pedestrian Detection failure 0x21 Kafas>Kombi
and another about Lateral stability DSC/ICM (which causes FCW failure CC message)

Was from 0713 but is possible to retrofit back to 2011, there is at least one on here who has done it to M6 and I know of a couple of Italians that have done it to a 2012 and 2011 5 series

Coding with later build date was an experiment, I now have information from one of the Italian guys that a later version ICM is needed along with the FRM3 with 106D Cafd.
